Microsoft Faces Complaints in EU Over Violating Children’s Data Privacy

Two complaints have been lodged towards the Austrian knowledge safety authority the place the tech giants allegedly violated youngsters’s knowledge safety rights.

Privacy rights organisation NOYB on Tuesday lodged two complaints with Austria’s knowledge safety authority towards tech big Microsoft for allegedly violating youngsters’s knowledge safety rights.

The non-profit organisation mentioned that Microsoft’s ‘365 Education’ providers violate youngsters’s knowledge safety rights.

When pupils needed to train their General Data Protection Regulation (GDPR) rights, Microsoft mentioned colleges have been the “controller” for his or her knowledge.

“However, the schools have no control over the systems,” mentioned NOYB .

Microsoft, alleged the grievance, is making an attempt to contractually dump most of its authorized duties underneath the GDPR on colleges that present Microsoft 365 Education providers to their pupils or college students.

“This means, for example, that access requests to Microsoft go unanswered – while schools have no realistic way of complying with such requests because they don’t hold the necessary data,” the non-profit talked about.

Maartje de Graaf, knowledge safety lawyer at NOYB, mentioned that this take-it-or-leave-it method by software program distributors equivalent to Microsoft is shifting all GDPR duties to varsities.

“Microsoft holds all the key information about data processing in its software but is pointing the finger at schools when it comes to exercising rights. Schools have no way of complying with the transparency and information obligations,” de Graaf mentioned.

Microsoft gives such “vague information” that even a professional lawyer can’t absolutely perceive how the corporate processes private knowledge in Microsoft 365 Education.

“It is almost impossible for children or their parents to uncover the extent of Microsoft’s data collection,” mentioned de Graaf.
